APC members seek Masari’s retention as Tinubu’s running mate

On Wednesday, two APC members formally petitioned the Federal High Court in Abuja to prevent the party from designating Masari Kabiru as its running mate in the general elections of 2023. On June 17, the APC chose Masari to serve as a temporary running mate for Asiwaju Bola Ahmed Tinubu, who is the party’s presidential candidate. Last month, Tinubu stated that he was still looking for a running companion. The APC’s attempt to replace Masari’s name was contested by the plaintiffs, Zakari Maigari and Zubainatu Mohammed, in a lawsuit filed on July 4, 2022 with the filing number FHC/ABJ/CS/1059/2022 and citing sections 142(1), 29(1), 31 and 33 of the Electoral Act.

The lawsuit included Masari, Tinubu, and the Independent National Electoral Commission (INEC) as respondents.

They investigated the propriety of substituting a different candidate for the placeholder.

In the same way that section 142(1) encourages the combined-ticket for the presidential candidate and vice-presidential candidate, the plaintiffs contend that section 187(1) of the 1999 Constitution permits the governorship candidate and deputy governorship candidate to have a joint ticket.
